Who is the data controller for the processing of my personal data on the Litterati platform?

Litterati Inc. is the controller of your personal data processed in relation to your use of the Litterati platform. This includes your use of our mobile application, dashboard, as well as our website and our interactions with you.

As Litterati Inc. is not located in the European Union, Litterati designated Social Sustainable Solutions SL. as its representative in the European Union.

Does Litterati process my personal data?

Yes. 

We process your personal data to enable you to use our platform, which includes our mobile application, dashboard, as well as our website and our interactions with you.

What types of personal data do we collect from you via our platform?

You may use the Litterati platform anonymously without providing any personal data, however, if you wish to see your litter data and access the platform fully you will need to create an account. By creating an account, we will collect, store and use different types of personal data about you. 

This personal data is (i) provided by you; and/or (ii) created by us in the course of your use of our platform.

For example, we process the personal data you include in your user account, such as your display name, username, profile picture, email address, location, password, biography, and gender. 

Further, we process personal data with regard to your activity on our platform, such as your litter geolocation (if you have opted in), the number of challenges you have participated in and the number of pieces of litter you collected. 

In addition, we process personal data to conduct surveys and to fulfill your contact, demo, data and subscription requests, such as your full name, title, department, city, town, country, organization name, function title, goals, password, email address, your answers to our survey questions and personal data you include your communication with us.

Why do we process your personal data?

We process your personal data to offer our services and operate our application in a secured and protected manner.

In particular, we collect, store and use your personal data, among others, to keep and maintain an accurate and adequate administration, to provide support services, to create analytical reports for improvement of our platform’s performance, to send and analyse direct marketing communications, to customize your experience of our mobile application to your preferences, and to determine your litter’s geolocation.

Furthermore, we share your personal data (display name, username, litter activity) with challenge organizers so that they are able to monitor their challenges and to communicate with you in this regard (if you have opted in).

Do we share your personal data with challenge organizers?

Yes, we share personal data with the organizer of the litter challenge(s) in which you participate. Most of this data is publicly available in our mobile app and through the dashboard.

We share the following types of your personal data (if provided by you) to enable the relevant partner to organize and manage its challenges: your display name, username, litter score, and litter geolocation.

In particular, we share your personal data with the relevant partner to enable the partner to (i) send (in-app) communication to you regarding the challenges (if you have opted in); (ii) visualise the results of the challenges; (iii) measure engagement and participation; and (iv) filter by challenge or user.

Where the sharing of your personal data with the partner is based on your consent, you can withdraw your consent at any time by sending an e-mail to [email protected]

How long do we retain your personal data?

We do not process your personal data longer than necessary for the processing purpose. 

We keep your personal data for as long as your account is active. 

You can deactivate your account by sending an email to [email protected] We will then remove your personal data. The remaining anonymized account will be made inactive and will only be used for analytics purposes and to improve the Litterati services. We will retain the litter data, but this will no longer be associated with you.

If the data is subject to a statutory retention period, we will retain your personal data for the period specified by the law. 

Notwithstanding the above, we may retain your personal data for the establishment, exercise or defence of legal claims. Likewise, we may retain your personal data to make it available to the supervisory authority, investigative authority, courts, or other governmental body for the period specified by the law.

What are my privacy rights?

Does Litterati transfer personal data outside the European Economic Area?

Yes. 

We store our users’ personal data on our servers located in the United States of America. Our processors may store our users’ personal data in other locations.

How does Litterati comply with the GDPR requirements for international data transfers?

Litterati is committed to secure and protect our users’ personal data.

In case of transfers of personal data to countries outside the European Economic Area, we ensure appropriate safeguards are in place to guarantee the continued protection of users’ personal data.

To comply with the GDPR requirements for international data transfers, we conclude, where necessary, the new version of the Standard Contractual Clauses (SCCs) as adopted by the European Commission with our data importers. For more information on the SCCs, please see here.

How does Litterati comply with the Schrems II ruling?

As a benefit to our users and customers, we have, where necessary, implemented supplementary security and data protection measures to supplement the safeguards under SCCs. These supplementary measures ensure that the data Litterati transfers outside the European Economic Area, is protected up to the GDPR-standard or an essentially equivalent level. These supplementary measures reflect the Recommendations 01/2020 of the European Data Protection Board for addressing the decision of the EU’s Court of Justice in the Schrems II case and article 14 of the SCCs.

Litterati’s supplementary measures include: 

First, we are committed to review the legality of government access requests and challenge these requests where there is a lawful basis to do so.

Second, we will inform Litterati users and customers if Litterati would receive a government access request, unless we are prohibited by law. 

Third, we will document and record any government access requests and the response provided, including the legal reasoning and customer/data subject involved, and make the records available to our users, unless we are prohibited to do so by law.

We stress that to date Litterati has not received any such requests and we are unlikely to ever receive one. 

Because we have taken the necessary supplementary measures required under the Schrems II ruling, Litterati’s customers that are subject to the GDPR enjoy an immediate advantage in meeting their own respective compliance obligations under the applicable data protection laws.
